The Best Travel Services website is compiled of various pages and operated by Best International Group of Companies. Use of this website is subject to these terms of use. Users who do not accept these terms of use are not authorised to use or continue using this website.

Best Travel Services reserves the right to change these terms and conditions at any time, and any revised version will be effective immediately. As a user of Best Travel Services website you warrant to Best Travel Services that you will not use the Best Travel Services website for any purpose that is unlawful or prohibited by these terms, conditions, and notices.

In accessing this website you agree not to use this website in such a way that: Disrupts, interferes with or restricts the use of this website by other users;

This website has been designed and these terms of use shall be governed by and construed in accordance with English law.

Terms of Business

1. General

a)  All terms held with Best Travel Services (BTS) and the Customer shall be on these terms and conditions, and all work undertaken by BTS shall be carried out on these terms and conditions unless otherwise expressly agreed in writing by BTS.

b)  No terms or conditions endorsed on, delivered with, or contained in a Customer’s purchase order, confirmation of order or other document shall form part of a Contract.

c)  The Customer acknowledges that they have not relied on any statement, promise or representation made or given by or on behalf of BTS, which is not set out in the terms. Nothing in this condition shall exclude or limit BTS’ liability for fraudulent misrepresentation or misleading statements.

d)  Each order or acceptance of a quotation by the Customer from BTS shall be deemed to be an offer by the Customer to buy Travel Arrangement Services subject to these conditions.

e)  No order placed by the Customer shall be deemed to be accepted by BTS until a written acknowledgement of the order is issued by BTS or (if earlier) BTS provides the Travel Arrangement Services to the Customer.

f)  The Customer shall ensure that the terms of its order and any applicable specification are complete and accurate.

g)  BTS shall provide such Travel Arrangement Services to the Customer as may be requested by the Customer and agreed by BTS from time to time. In the absence of any express written instructions to the contrary, BTS may accept (and the Customer shall be bound by) any requests made by any employee, agent or other representative of the Customer.

h)  By making a booking, the Customer authorises BTS to enter into a legally binding contract with relevant Third Party suppliers subject to the terms and conditions of that Third Party Supplier. For the avoidance of doubt, BTS shall not be responsible for any default or failure of any supply by any Third Party Supplier or for any loss, claim, cost, damage or injury incurred by the Customer or any Passenger (directly or indirectly) as a result thereof.

i)  No Passenger or any other third party will have any rights against BTS, whether pursuant to the Contracts (Rights of Third Parties) Act 1999 or otherwise.

j)  BTS dedicated travel professionals will always endeavour to respond to a travel booking within 1 hour of receiving the enquiry where possible.

2. Payment

a)  BTS shall contract with the Third Party Suppliers in order to procure and fulfill the travel requirements of the Customer and the Customer shall pay to BTS on demand all costs, fees, taxes etc invoiced by BTS to the Customer in respect of items contracted with the Third Party Suppliers and Travel Arrangement Services provided. All payments from the Customer to BTS shall be payable as 100% deposit guaranteeing due performance of the Travel Arrangement Services.

b)  If credit account facilities have been made available by BTS to the Customer then all sums due by the Customer to BTS shall be payable as set out in paragraph 2(c) below. BTS reserves the right (without having to give any reason) to decline credit account facilities or to withdraw such facilities. Should no such credit account facilities be made available by BTS to the Customer or should these facilities be at any time withdrawn then BTS reserves the right to request advance payment of a 100% deposit to guarantee due performance of the Travel Arrangement Services from the Customer in respect of all contracts to be entered into by BTS in order to procure and fulfill the Customer travel requirements and for all fees payable in respect of the provision of Travel Arrangement Services. Upon the withdrawal of credit account facilities all monies owed to BTS will become immediately payable.

c)  Payment by the Customer of monies outstanding upon credit accounts is due as cleared funds 30 days after production of statement, excluding invoices for foreign currency or travellers cheques, which are due for payment by the Customer upon receipt of the invoice.

d)  In the event of late payment the Customer shall pay interest on the amount of the monies outstanding at the rate of statutory interest under the Late Payment of Commercial Debts (interest) Act 1998 from the due date of actual payment. Late payments (outstanding more than 30 days after the due date) may also incur a late payment charge of £12 for each weekly reminder.

e) The Customer acknowledges that where credit is to be offered by BTS, BTS may need to conduct credit checks on the Customer. By placing an order for Travel Arrangement Services the Customer authorises BTS to pass information with respect to the Customer account to third parties for credit reference purposes.

3. Refunds

a)  No credit notes or refunds will be provided in relation to payments made to BTS as deposits of due performance of the Travel Arrangement Services. For the avoidance of doubt, all invoices issued by BTS in connection with a Contract will be unaffected by any claim by or on the Customer’s behalf for a refund from a Third Party Supplier, subject to paragraph (b) below.

b)  To the extent that any Third Party Suppliers offer refund policies, BTS will make details of such policies available to the Customer upon request on placing an order. Where the Customer proceeds to make a booking the relevant refund policies will be deemed accepted.

c)  Where a Customer wishes to apply for a refund in accordance with a Third Party Supplier refund policy, BTS will apply for such refund, and to the extent that any refund is received by BTS, BTS will retain the amount of such refund and credit it against the amounts payable by the Customer to BTS under the relevant Contract.

d)  Any refunds offered by Third Party Suppliers may only be applied for upon the return of the relevant documentation relating to the travel service concerned and are subject to the terms and conditions of the relevant Third Party Supplier.

e)  Without prejudice to the generality of Clauses 3(a), 3(b), 3(c) and 3(d) above, the Customer acknowledges and agrees that:

i: Any Third Party Supplier refunds in respect of rail travel services can only be issued provided the relevant documentation is returned within one month of date of the issue of the said documentation (or on any other terms relating to the ticket issued in respect of the rail services in question); and

ii: Not all tickets may be refunded or altered and that any refunds made may be subject to the deduction of any fees or charges, which BTS and/or the Third Party Supplier may from time to time levy.

4. Late Payments

If any sums due by the Customer to BTS are not paid when due then, without prejudice to any other remedies of BTS, BTS may at any time:

a)  Suspend all or part of the provision of Travel Arrangement Services to the Customer after 30 days plus 7 days; and/or

b)  Cancel (without any liability to the Customer or to any Passenger) any bookings made on behalf of the Customer, with any cancellation fees incurred as a result thereof being for the account of the Customer.

5. Liability

a)  As set out in these terms and conditions, all conditions, warranties and representations, expressed or implied by statute, common law or otherwise, in relation to the supply, non-supply or delay in supplying the Travel Arrangement Services are excluded to the fullest extent permitted by law.

b)  Subject to the provisions in clause 5(d) below, BTS is not liable to the Customer or any Passenger in contract, tort (including negligence or breach of statutory duty) or otherwise for any of the following losses or damages, whether direct or indirect, arising out of, or in connection with, the supply, non supply or delay in supplying the Travel Arrangement Services or otherwise in connection with any contract:(i) loss or damage incurred by the Customers or any Passenger as a result of third party claims; (ii) loss of actual or anticipated profits; (iii) loss of business opportunity; (iv) loss of anticipated savings; (v) loss of goodwill; (vi) injury to reputation; or (vii) any indirect, special or consequential loss or damage howsoever caused even if BTS was advised of the possibility of them in advance.

c)  Subject to clauses (a) and (b), the entire liability of BTS arising out of or in connection with the supply, non supply or delay in supplying the Travel Arrangement Services, or otherwise in connection with any Contract, whether in contract, tort (including negligence or breach of statutory duty) or otherwise, is limited to an aggregate figure equal to the amount of fees paid to BTS for the relevant Travel Arrangement Services or the additional costs incurred by the claimant, whichever is the lesser.

d)  Nothing in these terms and conditions shall operate to exclude or restrict BTS’ liability for death or personal injury resulting from negligence or for fraud or deceit

e)  The Customer acknowledges and agrees that it is reasonable and prudent for the Customer (and/or any Passenger) to put in place a policy of insurance in respect of any loss, claim, cost, damage or injury incurred in connection with the Travel Arrangement Services or any travel resulting therefrom. BTS shall endeavour to assist the Customer and/or the Passenger in obtaining such a policy of insurance from an insurer on the express request of the Customer and on payment of the appropriate premium. The Customer agrees to make each and every Passenger aware of the provisions of this Clause 5.

6. Waiver

No failure or delay by BTS to exercise any right or remedy arising under, or in connection with, any contract (collectively, any “action”) will act as a waiver, or otherwise prejudice or restrict the rights of BTS, in relation to that action or any other action. BTS’ rights and remedies arising under, or in connection with, any contract are cumulative and, except where otherwise expressly provided, do not exclude rights and remedies provided by law or otherwise.

7. Variation

BTS reserves the right to vary the terms of these Standard Conditions at any time by notifying the Customer in writing. Any such variation shall take effect in respect of any Travel Arrangement Services supplied on or after the fifth working day following the date of posting said notification to any address to which BTS has invoiced the Customer in the preceding three months or to the last such address if no invoices have been issued in the preceding three months.

8. VAT

VAT will be charged where applicable at the rate in force on the date of supply in addition to any fees and charges for the provision of Travel Arrangement Services.

9. Data Protection

BTS and the Customer shall each ensure that it complies fully with the requirements of Data Protection Act 1998 and the Customer shall ensure that any communication of personal employee data to BTS and the Third Party Suppliers has been properly authorised by the employee concerned. The Customer acknowledges that BTS may store the Customer’s and employee’s data outside of the European Economic Area, and consent is hereby granted to this. The Customer consents to contact from BTS via e-mail, letter or phone about products and services that may be of interest to the Customer. In the event that the Customer no longer wishes to receive contact from BTS, the Customer should contact BTS at its registered address or by email to info@besttravelservices.co.uk

10. Passport Visa and Immigration Requirements

The Customer’s specific passport and visa requirements, and other immigration requirements are the Customer’s responsibility, and therefore the Customer should confirm these with the relevant embassies / consulates. BTS do not accept any responsibility if Customer’s cannot travel because they have not complied with any passport, visa or immigration requirements.

11. Force Majeure

If BTS is delayed or prevented from complying with its obligations under a Contract by any event beyond its reasonable control, including, without limitation, acts of God, governmental actions, war or national emergency, acts of terrorism, protests, riot, civil commotion, fire, explosion, flood, epidemic, lock outs, strikes or other labour disputes (whether or not relating to BTS workforce) or any restraints or delays affecting Third Party Suppliers, then the requirement to comply with those obligations shall be suspended for as long as, and to the extent that, performance is delayed or prevented by that event.

12. Jurisdiction and Governing Law

These terms and conditions, any supply of the Travel Arrangement Services to the Customer and/or the Passenger and any Contracts between BTS and the Customer shall be governed by the law of England and shall be subject to the jurisdiction of the English Courts, without prejudice to the right of BTS to seek recovery of any sums due from the Customer before any court of competent jurisdiction.
